Corona woman’s murder conviction overturned by state Supreme Court

The California Supreme Court on Monday rejected an appeal from prosecutors and tossed out the conviction of a Corona nurse who was charged in 2003 with killing her boyfriend.

The high court sided with an earlier decision by a trial court saying the outcome of Kimberly Long’s trial would have been different had the jury heard about a time of death analysis.,

“The [trial] court ruled that expert testimony estimating time of death before [Kim] arrived home ‘could reasonably raise a reasonable doubt in the minds of the jurors’ and ‘could be fatal to the People’s case.’ Applying our independent judgment, we agree,” the Supreme Court said it its published opinion.

Long was charged in 2003 with killing her boyfriend, 33-year-old Oswaldo Conde, at her Springbrook Street home.

Long was released from prison in 2016 after a Riverside Superior Court reversed her conviction, finding the result of the trial would have been different had the jury heard from a time of death expert about when the victim died.

Long was released on bail despite an appeal by the Riverside County District Attorney’s.Office. The California Court of Appeal reversed the Superior Court ruling and the case was sent to the Supreme Court which reaffirmed Long’s innocence.
